Do DVC Resale Agents Have to Present All Offers to Their Seller?

When navigating the Disney Vacation Club (DVC) resale market, buyers often wonder if their agents are obligated to present every offer that comes to the seller. According to real estate industry standards, agents generally aim to present all offers to ensure sellers have the opportunity to consider every potential buyer. However, there are exceptions to this rule.

What do the Experts Say?

Realtor.com explains, Some sellers set a limit for how low they’re willing to go in price and ask their real estate agent to dismiss any offers below that price. “If the seller has specifically instructed the agent not to bring offers that do not meet a certain minimum requirement, the agent may not need to present any offer that falls short of the minimum,” says Phil Lunnon, a real estate agent in Lakewood, CO.

How Does This Relate to DVC?

This guidance holds true in the DVC resale market as well. If a seller has clearly communicated their minimum acceptable offer to their agent, the agent is within their rights to withhold any offers that do not meet this criterion. This can streamline the negotiation process, allowing sellers to focus only on serious offers that meet their expectations.

Additionally, state laws and brokerage policies can impact whether all offers must be presented. In some regions, real estate regulations may dictate that all offers be presented unless the seller has provided explicit instructions otherwise. Sellers should clarify with their agent how offers will be handled and ensure any minimum price thresholds are clearly stated in their agreement.

Things to Consider

While some buyers might find this frustrating, consider this. Small DVC contracts are the most popular because overall, they are priced lower and more affordable due to the minimum amount of points one is buying. Sellers who list small contracts are often the ones who receive an influx of offers with offers considerably below the asking price. Since the process for placing an offer for a DVC resale purchase is a simply one done online, it’s easy for a multitude of buyers to put in offers within minutes. Sellers then become inundated with offers, and it makes the selling process overwhelming and time-consuming. Because of this sellers of smaller point contracts will often instruct their agents not to accept offers below a certain threshold.

Therefore, while it is typical for agents to present all offers to their seller, there are scenarios where an agent may be instructed not to do so. By setting clear expectations and maintaining open communication, sellers can ensure their preferences are respected, and the selling process proceeds smoothly. It’s important for buyers to understand and respect the seller’s wishes and the agent’s obligation to meet those wishes.

    I have always seen smaller point contracts at higher prices not lower. I have purchased smaller contracts and they have all been higher than the larger contracts.
    Just my experience.
